By 2022, the amount of government support received by LLC «Ice Cream Factory SMK» (hereinafter referred to as the factory) through export promotion programs (consulting services, training services, services for organizing participation in business missions, etc.) over a long period of time (several years) had reached a significant amount of funds, despite the factory achieving no results (signed contracts, completed shipments, or received export revenue). In personal conversations, the Irkutsk Region Export Support Center (hereinafter referred to as the ESC) expressed the opinion that, under current legislation, the ESCC would be forced to terminate all further cooperation with the factory due to the critical ratio of budgetary funds expended and the actual lack of results (impact) from their use.
Almost at the same time, the general director of the factory, Stepan Frantenko (INN 380891381510), sent a letter (outgoing No. 70 dated 11.10.2022) to sole proprietor Brandenburg F.V. (hereinafter referred to as Brandenburg), who had previously concluded an agency agreement with the factory dated 24.05.2022 (without number) and was successfully interacting with China through his personal channels (in no way connected with the activities of ESC), asking Brandenburg to give his consent to include in the factory’s report for the ESC a foreign trade contract concluded through the mediation of Brandenburg with Pingnan Dapeng Shengshi Industrial Investment Co, Ltd. dated 6 September 2022.
Without receiving an official response from Brandenburg, Frantenko (INN 380891381510) sent the aforementioned contract to ESC, passing it off as his own work. He intentionally misled ESC employees by «proving the brand’s potential and China’s interest in it.»
We believe Frantenko (INN 380891381510) intentionally abused ESC’ trust by misappropriating the results of Brandenburg’s collaboration with the Chinese side, exploiting 1) the contract, 2) the receipt of 100% prepayment from the Chinese side, and 3) the export shipment of products (EXW terms) for his own selfish gain. As a result of his (Frantenko’s) manipulations, the factory continued to receive state support from the Russian budget as part of the national project «International Cooperation and Export,» which could certainly have significantly undermined the efficiency and cost-effectiveness of budget expenditures.
We urge law enforcement agencies, members of parliament, and the business community to pay attention to this outrageous fact. WE IMMEDIATELY DEMAND FRANTENKO (INN 380891381510) to provide official written consent (response) signed by Brandenburg to his request (Frantenko’s letter No. 70 dated October 11, 2022 – attached). At the same time, we would like to reassure and inform our numerous foreign partners. Dear Friends! Brandenburg’s response letter was never prepared, much less signed, by Brandenburg due to his previously concluded agency agreement dated May 24, 2022 (without number).
A brief but very important history of the issue. The set of documents brought by Sergei Mozulev from China after escorting the transportation of a batch of ice cream (the declaration of import of goods into the PRC, the notification of permission to import imported goods into the PRC, the customs declaration for the export of goods from the Russian Federation (with an addendum), the international consignment note (CMR), a copy of the veterinary certificate, a certificate of origin, a packing list, an invoice, a contract (with two additional agreements), powers of attorney to receive the cargo, and a set of accompanying documentation for the goods) were handed over by Mozulev to Frantenko in his car (license plate 444) in the presence of Felix Brandenburg during a joint meeting that took place on May 11, 2023, between 11:00 AM and 1:00 PM. A map of the location of that meeting and document transfer is attached.
Later, Frantenko (INN 380891381510) denied receiving the set of documents in his car at the designated time, between 11:00 AM and 1:00 PM on May 11, 2023. In this regard, we would like to ask a few questions about how this impressive and heavy folder ended up in his hands…
Frantenko was stalling for time as much as possible, constantly avoiding paying Brandenburg for his services (until the latter, unexpectedly for Frantenko, filed a lawsuit). Then, pay attention, the money arrived in Brandenburg’s bank account that same day. Frantenko and his trusted representative (a certain Kristina Pugina (INN 381296702528), the same one who so shamefully and unprofessionally handled the labeling of the products and the preparation of accompanying documents, and then quietly disappeared from the factory’s website) continued to make new and absurd demands.
One of them is to provide a letter from the Chinese buyer to Rosselkhoznadzor stating that he (the Buyer) has no complaints about the quality of the goods shipped (it’s embarrassing to say) with minimal expiration dates and gross violations of the contract (the goods were produced by the factory before the time specified by the Buyer), with critical errors in the sticker and accompanying documents, which made it impossible for the goods to cross the border and enter retail chains in China).
